國際電子商情訊,諾基亞(Nokia)公司在本周二(6月14日)表示,蘋果將一次性支付一筆賠償金給諾基亞,并在今后的一段時(shí)間內(nèi)付給Nokia專利使用費(fèi),以平息與雙方在專利授權(quán)協(xié)議方面的長期糾紛。根據(jù)協(xié)議,雙方的一切專利糾紛將就此和解,雙方將撤回一切針對對方的專利侵權(quán)指控。
和解條款包括了撤消雙方在美國國際貿(mào)易委員會(U.S. International Trade Commission)對彼此的申訴,Nokia表示,但合同的具體條款是“商業(yè)機(jī)密”。
諾基亞和蘋果自2009年起,就在國際貿(mào)易委員會(ITC)等地方相互提起多個(gè)訴訟,自從蘋果推出第一款iPhone,這兩家公司便開始就GSM、3G和Wi-Fi等十余項(xiàng)專利糾紛互相攻擊。根據(jù)調(diào)研公司Strategy Analytics,在今年第一季度,蘋果已經(jīng)超越諾基亞,成為手機(jī)銷售收入世界排名第1。

在一份聲明中,Nokia公司總裁兼首席執(zhí)行官Stephen Elop表示,Nokia很高興這份協(xié)議能夠簽署,這也將使我們在移動通信市場中獲得更多的專利授權(quán)機(jī)會。
諾基亞稱,在過去二十年間,它已投入約430億歐元(約至623億美元,按目前匯率)到研發(fā)中。該公司聲稱已經(jīng)擁有1萬項(xiàng)以上的專利,是目前無線業(yè)界最強(qiáng)大,涵蓋面最廣的專利組合之一。

媒體普遍認(rèn)為對于經(jīng)歷了市場份額不斷下降和戰(zhàn)略動蕩的難熬時(shí)期諾基亞來說,上述協(xié)議是一個(gè)難得的好消息。雖然具體賠償數(shù)額未公布,但分析師認(rèn)為一次性賠償?shù)慕痤~將達(dá)上億歐元,也有小道消息稱,蘋果之后售出的每一部iPhone,將支付給諾基亞超過11美元的專利授權(quán)費(fèi)用,但此消息未經(jīng)證實(shí)。

Apple agrees to license Nokia patents

SAN FRANCISCO--Apple Inc. will pay a one-time lump sum and ongoing royalties of undisclosed amounts in a patent licensing agreement with Nokia Inc. that settles all patent litigation between the two companies, Nokia said Tuesday (June 14).
The terms of the settlement include withdrawal by both companies of complaints against the other with the U.S. International Trade Commission, Nokia (Espoo, Finland) said. The specific terms of the contract are confidential, the company said.
Nokia and Apple have filed several complaints against one another in the ITC and other venues since late 2009. The two companies have become heated rivals since Apple introduced the original iPhone. In the first quarter of this year, Apple overtook Nokia to become No. 1 in the world in handset revenue, according to research and consulting firm Strategy Analytics Inc.
In a statement, Stephen Elop, Nokia’s president and CEO, said the company was pleased with the licensing deal, which he said would open to the door for Nokia to further licensing opportunities in the mobile communications market.
Nokia said it has invested about 43 billion euro (about $62.3 billion at current conversion rates) in R&D over the past two decades. The company claims to have built one of the wireless industry’s strongest and broadest patent portfolios, with more than 10,000 patents.
Nokia said it expects the Apple agreement is expected to have a positive financial impact on the company’s recently revised outlook for the second quarter. Nokia said late last month it expects net sales from devices and services to be substantially below its previously expected second quarter range of between 6.1 billion euro ($8.8 billion) and 6.6 billion euro ($9.5 billion).
