美國(guó)晶片廠 Freescale(飛思卡爾半導(dǎo)體)控告包含聯(lián)發(fā)科在內(nèi)的多家廠商侵權(quán),美國(guó)國(guó)際貿(mào)易委員會(huì)(ITC)準(zhǔn)備開(kāi)始展開(kāi)調(diào)查,將接受這項(xiàng)調(diào)查的廠商包括:日本船井電機(jī)(Funai Electric)、新澤西州船井公司(Funai Corporation, Inc., of Rutherford, NJ)、臺(tái)灣聯(lián)發(fā)科技(MediaTek Inc)、加州卓然公司(Zoran Corporation)。
美國(guó)國(guó)際貿(mào)易委員會(huì)發(fā)表的一份聲明中稱,飛思卡爾7月8日所提出的申訴,主要控訴這些公司侵犯其電路訊號(hào)反射專利權(quán),違反美國(guó)關(guān)稅法第337節(jié),要求ITC發(fā)布禁制令,禁止相關(guān)廠商的產(chǎn)品進(jìn)口至美國(guó)銷售。對(duì)此聯(lián)發(fā)科表示,案件已進(jìn)訴訟程序,細(xì)節(jié)部分不便對(duì)外說(shuō)明,不過(guò)聯(lián)發(fā)科強(qiáng)調(diào)TV晶片出貨與營(yíng)收皆不會(huì)因此受到影響。
根據(jù)美國(guó)國(guó)際貿(mào)易委員會(huì)(USITC)周一在官網(wǎng)上發(fā)布的新聞,該委員會(huì)已經(jīng)投票通過(guò),對(duì)部分集成電路(IC)、芯片組和電視等包含相關(guān)芯片的產(chǎn)品提起侵權(quán)調(diào)查。按照標(biāo)準(zhǔn)程序,ITC首席行政法官將指定6位法官,然后舉行聽(tīng)證會(huì)。法官會(huì)作出初步判定這些公司是否有侵犯飛思卡爾的專利,并且初審結(jié)果會(huì)受到整個(gè)國(guó)際貿(mào)易委員的審查后才確定。
ITC表示,調(diào)查在45天之內(nèi)會(huì)有初步結(jié)果。
業(yè)內(nèi)人士表示,聯(lián)發(fā)科目前營(yíng)收當(dāng)中,有7成來(lái)自手機(jī)芯片,電視芯片比重僅占約10~15%,比例相對(duì)低,加上目前聯(lián)發(fā)科把重點(diǎn)擺在中國(guó)內(nèi)地電視市場(chǎng),因此飛思卡爾這次對(duì)聯(lián)發(fā)科提出的訴訟,“警告”的意味更大,對(duì)于聯(lián)發(fā)科的營(yíng)運(yùn)并不會(huì)造成什么實(shí)際上的影響。

ITC to investigate Freescale complaint against TV chip firms

SAN FRANCISCO—The U.S. International Trade Commission (ITC) will investigate a complaint brought by Freescale Semiconductor Inc. against TV chip vendors including MediaTek Inc., Zoran Corp. and Funai Electric Co. Ltd., the ITC said this week.
The complaint, brought by Freescale (Austin, Texas) June 8, alleges that the chip vendors violate patents held by Freescale and requests that the ITC issue an exclusion order and cease and desist orders against infringing ICs, chip sets and TVs containing them, according to a statement issued by the ITC.
Following standard procedure, the ITC said its chief administrative law judge would assign the case to one of the ITC's six administrative law judges, who will then schedule and hold an evidentiary hearing. The judge will make an initial determination as to whether the chips in question violate Freescale's patents, and that initial determination will be reviewed by the entire ITC.
Within 45 days after the start of the investigation, the ITC will set a target date for its completion the ITC said.
Funai's U.S. subsidiary, based in Rutherford, N.J., was also named in the complaint.
